Terms of Service

1. Agreement to Terms

By purchasing any service from SiteSmith AI ("Company," "we," "us"), you agree to these Terms. If you do not agree, do not purchase.

2. Services

SiteSmith AI provides website design, hosting, and automated marketing services for local service businesses. Services are described in detail at sitesmithai.pages.dev/services.html. Service tiers:

  • Bare Bones — $97 setup fee + $97/month recurring subscription
  • Full Website — $297 setup fee + $297/month recurring subscription
  • Custom engagements are scoped separately and priced individually

3. Payment Terms

All services require an upfront setup fee and a recurring monthly subscription. Setup fees are charged at the time of purchase. Monthly subscriptions begin on the go-live date of your website. Payments are processed via Stripe. Accepted payment methods: Visa, Mastercard, American Express, and Discover.

4. Cancellation

Either party may cancel with 30 days written notice to luke@sitesmithai.com. Service continues for 30 days after notice is received. Monthly billing stops at the end of the 30-day notice period. There are no cancellation fees.

5. Refund Policy

Setup fees are non-refundable once your website build has commenced, which occurs within 3 business days of payment. Setup fees are refundable in full if your build has not started within 3 business days of payment. Monthly subscription fees are non-refundable for the current billing period.

6. Client Responsibilities

Clients must provide accurate business information, logo and photos (if available), and access to existing accounts (Google Business Profile, Facebook, etc.) as needed for setup. Failure to provide required information within a reasonable timeframe may delay delivery beyond the stated 3-business-day target.

7. Intellectual Property

Website templates, code, and automation frameworks are the property of SiteSmith AI. Content provided by the client, including text, images, and logos, remains the client's property. Upon cancellation, the client receives a content export (text and images). Template code and automation systems are not transferred upon cancellation.

8. Service Level

We target website delivery within 3 business days of setup fee payment and completion of the intake form. GoHighLevel automation features (missed-call text-back, review requests, reactivation campaigns) go live within 7 business days. These are targets, not contractual guarantees.

9. Limitation of Liability

SiteSmith AI's total liability for any claim arising out of or related to these Terms or the services provided shall not exceed the total fees paid by the client in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities.

10. Governing Law

These Terms are governed by the laws of the State of Hawaii, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Honolulu County, Hawaii.
