These Terms of Service govern your use of sitesmithai.com and any services you buy from SiteSmith AI, a DBA of Alexzander Enterprises LLC ("SiteSmith," "we," "us"). By booking a call, signing an order, or paying for services, you agree to these Terms. If you sign a written services agreement with us, that agreement controls wherever it differs from these Terms.
SiteSmith builds and operates done-for-you outbound systems for B2B service businesses. Depending on your agreement, that can include:
The exact scope, volumes, and deliverables for your engagement are set in your written agreement or order. We do not publish standard pricing. Every engagement is quoted.
Engagements have a one-time setup fee and a monthly fee, in the amounts stated in your agreement. Payments are processed by Stripe. The setup fee is due at signing. The monthly fee is billed in advance, starting on your agreement's effective date and on the same day each month after that. If a payment fails, we may pause sending and lead delivery until the account is current.
Service is month to month, with no minimum term. Either party may cancel with 30 days written notice. Email to chase@sitesmithai.com counts as written notice. Service and billing continue through the notice period. Months already paid are not refunded. There are no cancellation fees.

You are the sender of record for all email and text messages sent on behalf of your business, and you are responsible for complying with the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), state telemarketing and texting laws, carrier rules, and platform policies for your messages and offers.
We build every email sequence with a working unsubscribe path and a valid physical mailing address, and we honor opt-out requests promptly. We scrub phone lists (line type, do-not-call, known litigator, and reassigned number checks where applicable). Scrubbing reduces risk. It does not create consent and does not transfer your legal responsibility to us.
Opt-out and suppression lists are shared in both directions, are kept after the engagement ends, and are used only to make sure people who opted out are not contacted again.
Reply rates, deliverability, meetings booked, and revenue depend on your offer, your market, your list, and how quickly your team follows up. Any figures shown on our website come from SiteSmith's own campaigns. Past results do not guarantee yours, and results vary. We do not guarantee inbox placement, a number of replies, meetings, or sales.
When an engagement ends, you keep: the sending domains registered for your business, the copy and playbooks we delivered to you, your contact data, conversations, and campaign records, and any automations we built inside your own GoHighLevel account. If we ran any part of the system in our own accounts, we export your data to you within 14 days of the end date.
Our internal software, scripts, templates, and methods remain ours.
SiteSmith has an existing exclusivity obligation covering businesses that provide HVAC, electrical, or plumbing services. Systems we build may not be used to sell services into those trades beyond what that obligation allows. We confirm at signing whether your target market is affected.
SiteSmith's total liability for any claim arising out of or related to these Terms or our services will not exceed the fees you paid us in the 3 months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities.
We may update these Terms. The date at the top of this page shows when they last changed. Changes do not alter a signed written agreement unless both parties sign an amendment.
These Terms are governed by the laws of the State of Hawaii, without regard to conflict of law provisions. Any disputes will be resolved in the courts of Honolulu County, Hawaii.
